1. notarized purchase agreement

To acquire ownership of a property in Spain, a notarized purchase contract (escritura pública de compraventa) should always be concluded so that you can be entered as the owner in the Spanish property register (registro de la propiedad), similar to the German land registry.

2. examination of the documents depending on the type of property

Before the notarized purchase agreement is concluded, you should thoroughly check all documents relating to the property. There are differences here, whether it is a second-hand house, a second-hand apartment or a new build.

3. reservation or purchase option contract

In many cases, the interested buyer is offered the conclusion of a so-called purchase option contract. This gives the buyer the opportunity to "reserve" the property against payment of an option premium (in practice up to 10% of the purchase price). Before signing such a purchase option contract, the buyer should check it thoroughly, as in most cases the payment of the reservation contract represents an unsecured advance payment. First of all, we will check the details of the property and discuss the payment modalities and possible financing. A reservation contract can then be signed between the seller and buyer. The notarized purchase contract is then prepared. Once signed, the notarial deed is executed and entered into the Spanish land register. We will explain the process to you and take over the preparation, support and execution of the purchase of the property for you. If you do not yet have a Spanish Foreigner Identification Number (NIE number), which is mandatory for the purchase of a property, we will be happy to help you. Sale of a property You will also receive advice and representation when selling your property in Spain. We will prepare any reservation or option contract, clarify the payment modalities, prepare the notarized purchase contract and provide you with legal support throughout the entire process. If you have inherited a property in Spain, you must first be registered in the Spanish land register in order to be able to sell it. This is done in Spain by means of a declaration of acceptance of inheritance before a Spanish notary. We can initiate the necessary steps for you and represent you legally until the property is entered in the Spanish land register.
